Vera respects copyright. We respond to clear notices of alleged infringement under the Digital Millennium Copyright Act (17 U.S.C. § 512), and we terminate the accounts of repeat infringers in appropriate circumstances.

Submitting a notice of infringement

If you believe material on Vera infringes your copyright, send our Copyright Agent a written notice that includes all of the following:

  1. A physical or electronic signature of the copyright owner, or a person authorised to act on their behalf.
  2. Identification of the copyrighted work you claim has been infringed.
  3. Identification of the material you claim is infringing, with enough detail for us to locate it — for a Vera post, include the share link or the username and approximate time of posting.
  4. Your contact information: name, address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law.
  6. A statement that the information in your notice is accurate, and, under penalty of perjury, that you are the copyright owner or authorised to act on their behalf.

Incomplete notices may delay our response. Please note that under 17 U.S.C. § 512(f), knowingly making a material misrepresentation that material is infringing can make you liable for damages, including costs and legal fees.

What happens next

When we receive a valid notice we will act expeditiously to remove or disable access to the material, and we will notify the user who posted it, passing on a copy of the notice.

Counter-notice

If your content was removed and you believe that was a mistake or misidentification, you may send our Copyright Agent a counter-notice containing:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and where it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the district in which you live (or, if outside the United States, any district in which we may be found), and that you will accept service of process from the person who submitted the original notice.

If we receive a valid counter-notice, we will forward it to the original complainant. Unless they notify us within 10–14 business days that they have filed a court action seeking to restrain the activity, we may restore the material.

Repeat infringer policy

We record copyright notices against the account that posted the material. An account that accumulates repeated valid notices will be terminated. We may also terminate an account immediately, without prior strikes, in cases of severe or clearly wilful infringement. Terminated users may not create new accounts to evade enforcement.

Because Vera only accepts media captured inside the app, most infringement risk comes from what is within frame or audible in a recording — for example music playing in the background, or a screen showing someone else's work. Filming something does not by itself give you the right to publish it.

Trademark and other rights

For trademark, publicity, privacy or other non-copyright complaints, email pollsplusapp@gmail.com describing the right you hold and the material at issue.

Reporting inside the app

Every post in Vera can be reported directly from the app, including a "Copyright infringement" reason. In-app reports reach our moderation queue. A formal DMCA notice, however, must be sent to the Copyright Agent above and contain all of the elements listed on this page.
